What your file holds
- Your identity and contact details, and Medicare or fund details
- Medical history, medications, allergies
- Consultation notes and examination findings
- Clinical photographs - part of the medical record, not marketing material
- Consent forms
- Operation reports, anaesthetic records, pathology results
- Implant or device details, including batch numbers
- Correspondence with your GP and other practitioners
- Accounts and payment records
Who can see it
Your health information is protected by the Privacy Act 1988 and the Australian Privacy Principles. It is available to:
- The practitioners and staff directly involved in your care
- Other practitioners you are referred to, with your consent
- Your GP, where correspondence is part of your care
- Health funds and Medicare, limited to what is needed for a claim you make
- Anyone you specifically authorise in writing
It is not available to family members without your consent, to employers, to insurers beyond a claim you have made, or to anyone for marketing.
Limited exceptions exist where the law requires disclosure - a court order or subpoena, mandatory reporting obligations, or a serious and imminent threat to someone's safety.
Photographs, specifically
This is where people most often assume more than is true.
- Clinical photographs are taken with your consent and stored securely as part of your record
- Separate, specific, written consent is required before any image is used anywhere else - a website, a gallery, a presentation, social media
- You may withdraw that consent, and images already published will be removed going forward
- Consenting to photographs for your record is not consent to publication
- Published before and after images must be genuine, unretouched and taken under consistent conditions - see the gallery
Getting copies
You have a right of access to your own health information. Request it in writing; we will normally respond within 30 days. A reasonable administrative fee may apply for copying, but not for making the request.
Take your records with you if you are getting a second opinion or moving practitioners - operation notes and implant details in particular.
If something in your record is wrong, you can ask for it to be corrected, and if we disagree you can have a statement of your view attached to the file.
How long records are kept
Adult health records in Victoria are kept for at least seven years from the last entry. For a patient treated as a child, records are kept until they turn 25.

Raise it with the clinic first - phone 1300 852 050 or email doctors@meclinic.com.au. If you are not satisfied, contact the Office of the Australian Information Commissioner at oaic.gov.au or 1300 363 992, or Victoria's Health Complaints Commissioner at hcc.vic.gov.au or 1300 582 113.
